Introduction

These Terms and Conditions constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Careerboat.ai Private Limited ("we", "us", or "our"), governing your access to and use of the Careerboat.ai website, applications, tools, and any related media, channels, or mobile platforms (collectively, the "Platform").

• You are not a minor in the jurisdiction in which you reside.
• You will not access the Platform through automated or non human means, including bots or scripts.
• You will not use the Platform for any illegal or unauthorised purpose.
• Your use of the Platform will not violate any applicable law or regulation.

If you provide information that is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and refuse current or future access to the Platform.

You may not use the Platform for any purpose other than that for which it is made available. The following activities are strictly prohibited:

• Systematically scraping or retrieving data from the Platform to build databases, directories, or collections without our written permission.
• Attempting to trick, defraud, or mislead us or other users, including attempting to obtain sensitive account information such as passwords.

• Using information obtained from the Platform to harass, abuse, or harm another person.
• Making improper use of support services or submitting false reports of abuse or misconduct.

• Engaging in unauthorised framing of or linking to the Platform.
• Uploading or transmitting viruses, malware, spam, or any material that disrupts the Platform's operation.

• Removing or altering any copyright or proprietary notices from Content.
• Attempting to impersonate another user or person.
• Selling or transferring your account or profile to another party.
• Uploading spyware, tracking pixels, or similar passive data collection mechanisms.
• Interfering with or placing undue burden on the Platform's infrastructure.
• Harassing, threatening, or intimidating our employees or agents.
• Attempting to bypass any security measures on the Platform.
• Copying, adapting, or reverse engineering any software that comprises the Platform.
• Using the Platform to compete with us or for any revenue generating commercial purpose not approved by us.

4. User Generated Contributions

The Platform may allow you to create, post, submit, or share content including text, videos, audio, photographs, comments, or other material ("Contributions"). Contributions may be visible to other users and third parties.

By posting Contributions, you represent and warrant that:

• Your Contributions do not infringe any third party's rights.
• You have the necessary rights and permissions to post them.
• Your Contributions are accurate and not misleading.
• Your Contributions are not spam or promotional material.
• Your Contributions are not abusive, obscene, or harmful.
• Your Contributions do not harm or exploit minors.
• Your Contributions comply with all applicable laws.
• Your Contributions do not include hateful or discriminatory content.

Violation of these terms may result in suspension or termination of your access to the Platform.

We may edit or remove content at our discretion without notice.

When leaving reviews or ratings, you agree to the following:

• You must have firsthand experience.
• No abusive, offensive, or hateful language.
• No discriminatory content.
• No references to illegal activity.
• No reviews if affiliated with competitors.
• No false or misleading information.
• No manipulation of reviews or campaigns.

We may remove or reject reviews at our discretion. Reviews do not represent our views.

Informal resolution

Before initiating any formal legal proceedings, both parties agree to first attempt to resolve any dispute through good faith informal negotiations for a period of at least 30 days from the date written notice of the dispute is given.

Formal resolution

If the dispute cannot be resolved informally, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended from time to time. The arbitration shall be conducted in English, and the seat of arbitration shall be India.

Exceptions

Disputes relating to intellectual property rights, claims of theft or piracy, invasion of privacy, or requests for injunctive relief are not subject to the informal resolution or arbitration provisions above and may be brought directly before a competent court.

Time limit

Any dispute must be raised within one (1) year of the cause of action arising. Claims raised after this period will not be entertained.

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Careerboat.ai disclaims all warranties, express or implied, in connection with the Platform and your use of it. We make no warranties regarding the accuracy or completeness of the Platform's content and will not be liable for any errors, interruptions, unauthorised access, bugs, or loss of data resulting from your use of the Platform.

We do not endorse or take responsibility for any products or services offered by third parties through the Platform.

21. Limitations of Liability

To the fullest extent permitted by applicable law, Careerboat.ai and its directors, employees, and agents will not be liable for any indirect, consequential, incidental, special, or punitive damages including loss of profit, revenue, or data arising from your use of the Platform. Our total liability to you for any claim, regardless of the cause, will be limited to the amount you have paid us, if any.

Certain laws may not allow limitations on implied warranties or damages. If such laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.

There is no joint venture, partnership, employment, or agency relationship created between you and Careerboat.ai as a result of these Terms.
